BACKGROUND:

This agreement applies to the User of this Web Site who must be 18 years and above of age and AfrikMoney. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site.

If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

AfrikMoney is a limited liability company established in the United Kingdom with registered office at 200 Brook Drive, Reading, England, RG2 6UB. The company is an authorised and regulated by the Financial Conduct Authority (FCA)as a Small Payment Institution (SPI) and supervised by Her Majesty’s Revenue and Customs.

Our Service enables a sender(customer) to enter into a contract either for money remittance or other services provided by our website and our mobile app.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Content”
means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;
“The Company”
means AfrikMoney
“Service”
means collectively money remittance or any online facilities, products, services available through the Web Site either now or in the future;
“The Transfer Fee”
means the applicable fees charged by the company for the service
“User” / “Users”
means any third party that accesses the Web Site and is not employed by the company
“Beneficiary”
means the recipient or the person identified as the benefactor(receiver) of the services purchased
“Sender”
Means customer who initiates the transaction to the other party and enters into a contract with the company

2. Intellectual Property

2.1 All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of the company , our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.

3. The Transaction

Transfer Fees. In consideration for the use of the Service, you agree to pay to the company a fee for each Money Transfer initiated by you at the applicable rate then in effect (the "Transfer Fee"). The applicable Transfer Fee for your transaction will be provided to you prior to your final authorization of the transaction.

Currency Exchange. In addition to the transfer fees applicable to all transactions, a currency exchange rate will be applied. The company’s exchange rate are fully displayed at the start of every transaction. All payments will be made in the currency of the destination country.

Recipient Data. The company is not responsible for incorrectly entered recipient details and once a transfer has been receipted/completed in the receiving country, this cannot be recalled. In exceptional cases, The company will do its best to hold/block wrong recipient and cancel the transaction at a fee if the recipient country has not completed the transaction.

Payment. Transfer fees and the principal amount are due and payable before any transaction is processed. These must be credited into the company’s bank account if paying via bank transfer or using the payment gateway online payment.

Transaction limit
Individual customers have a daily transaction limit of £5k and a monthly limit of £20k whilst business customers have a daily limit of £10K and a monthly limit of £100k, We reserve the right at anytime to decline, hold and cancel any transaction which do not comply with our money laundering and take necessary management decisions regarding all suspicious transaction.

Note there are also limits on card payments and once this cap is reached, customers can make bank transfers but will also be limited to the caps above. Our systems are configured to flag repeated transactions for audit clearance

Destination countries also have a cap on the maximum amount a recipient can receive and in such cases our system is configured to match destination countries rules and caps to avoid refunds and cancelations

Transfer delivery Timing
Mobile Top-Up: Delivery within 10mins or payment clearance
Mobile Money : Delivery within 10min of payment clearance
Cash Pay- Out :Same day delivery at designated. Maximum cash payment applies
Bank transfer : 48hrs delivery. Depending on Bank crediting timeframes, some bank might take an extra day leading to a maximum of 72hrs. For all transactions completed before 11am UK time, we will aim to credit account within 24hrs for certain Countries.

4. Maintaining your personal data

If you create an account at the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

5. Links to Other Web Sites

This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of the company or that of our affiliates. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.

6. Privacy

6.1 For the purposes of applicable data protection legislation, the AfrikMoney will process any personal data you have provided to it in accordance to its Privacy Policy available on the website .

6.2 You agree that, if you have provided AfrikMoney with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to AfrikMoney and (2) that you have brought to the attention of any such third party the Privacy Notice available on the AfrikMoney’s website or otherwise provided a copy of it to the third party. You agree to indemnify AfrikMoney in relation to all and any liabilities, penalties, fines, awards or costs arising from your non-compliance with these requirements.

7. Disclaimers

7.1 No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.

7.2 The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

7.3 AfrikMoney accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, AfrikMoney accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

8.2 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

9. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

10. Changes and Amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do we will send you an email to notify you. Continued use of the Website after any such changes shall constitute your consent to such changes.

11. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

12. Notices

All notices / communications shall be given to us either by post to our Premises (see address above) or by email to Info@WireBoon.com. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

13. Law and Jurisdiction

These terms and conditions and the relationship between you and AfrikMoney shall be governed by and construed in accordance with the Law of England and Wales and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
